🌿 NELSON PLANT GUY — TERMS & CONDITIONS
Welcome to Nelson Plant Guy. We value transparency, good communication, and healthy plants.
These terms outline how orders, shipping, returns, guarantees, rewards, referrals, payments, proprietary cultivars, and other aspects of purchasing from Nelson Plant Guy work so you can shop confidently and stress-free.
1. Plant Descriptions & Photos
We do our best to provide accurate plant descriptions and clear photographs to help customers understand what they are purchasing.
Product listings may include a combination of photographs of the actual plants or stock available, supplier or breeder photographs, and example images of mature specimens sourced from publicly available online sources.
Mature specimen images are provided for identification and illustrative purposes only, to demonstrate how a particular species or cultivar may appear as it develops and matures.
Where an image is an example of a mature plant, it should not be taken as a representation of the exact size, maturity, colour, variegation, leaf shape, or overall appearance of the plant being purchased.
Plants are living products and every specimen is naturally unique. Size, colour, leaf shape, growth habit, variegation, and other characteristics may vary between individual plants and may change as the plant matures.
2. Pricing, Payment & Order Timeframes
Pricing
All prices are in NZD.
Payment must be made in full before your order is processed.
Payment Timeframes
Orders must be paid within 48 hours unless an extension has been approved by Nelson Plant Guy in writing.
Unpaid orders may be cancelled and returned to stock.
3. Order Acceptance & Availability
Placing an order constitutes an offer to purchase.
We confirm orders once stock availability has been verified.
If an item becomes unavailable, we will contact you and provide appropriate options.
4. Shipping & Delivery
Dispatch Schedule
Shipping is generally carried out on Mondays and Tuesdays only.
Couriers
We use NZ Post Courier and other trusted carriers where appropriate.
Tracking information will be provided once your order has been dispatched.
Weather Holds
Orders may be held where weather conditions, courier delays, public holidays, or other circumstances may place the health of live plants at unnecessary risk.
Responsibility After Dispatch
Once dispatched, plants are in the care of the courier.
We will assist where reasonably possible if a parcel is delayed, lost, or damaged in transit.
5. Weekly Shipping Structure & Eligibility
• The first order of the week must include paid standard shipping.
• If combined eligible orders subsequently reach the applicable free-shipping threshold, the initial shipping fee may be refunded.
• The weekly shipping period resets each Sunday at 7pm.
• Customers placing additional orders within the same shipping period may select “local pickup” where those orders are intended to be combined with an existing shipment.
6. Packaging Standards
Plants are packaged carefully and securely using appropriate protective materials.
Despite careful packaging, minor cosmetic impacts can occasionally occur during transit.
7. Live Plant Disclaimer
Plants are living products and may experience temporary stress during transport.
This can include minor drooping, leaf movement, cosmetic blemishes, temporary softening, or other minor changes associated with shipping and environmental adjustment.
Minor transit or acclimation stress does not automatically constitute damage or qualify a plant as dead on arrival.
8. Returns, Refunds & Replacements
We do not accept change-of-mind returns on live plants.
For plants that arrive dead or with serious shipping damage:
• Contact Nelson Plant Guy within 48 hours of delivery.
• Provide clear photographs of the plant, packaging, and courier label.
• Where appropriate, we may offer a replacement, refund, store credit, or another reasonable resolution.
After 48 hours, ongoing plant health and care generally become the customer’s responsibility.
Nothing in these terms is intended to exclude or limit any rights you may have under applicable New Zealand consumer law.
9. Customer Responsibilities
Customers are responsible for:
• Providing an accurate and complete delivery address.
• Retrieving parcels promptly following delivery.
• Providing suitable care and environmental conditions after the plant arrives.
• Following any specific acclimation or care instructions supplied with the plant where applicable.
Incorrect addresses, failure to collect parcels promptly, or unsuitable care following delivery may affect eligibility under our guarantees.
10. 60-Day Price Guarantee
At Nelson Plant Guy, we stand behind our pricing and aim to offer fair, consistent value to our community.
If an item purchased through our website is reduced in price within 60 days of your purchase date, you may be eligible for store credit for the difference.
This guarantee applies to standard listings and new releases unless otherwise stated.
What’s Covered
• Applies to eligible online purchases made through our website.
• Covers price reductions on the same product listing, including matching size, grade, or product variation where applicable.
• Valid for 60 days from the original purchase date.
Market Specials & Promotional Pricing
From time to time, we may run market specials, event-based promotions, or limited-time offers both in person and online.
These promotional prices are excluded from the 60-Day Price Guarantee.
This includes:
• Botanica Market specials.
• Other plant market or event pricing.
• After-market restock promotions.
• Flash sales or limited-time drops.
• Bundle deals.
• Promotional giveaways.
• Other temporary promotional offers.
These offers are event-driven or promotional and are not considered standard retail pricing.
Key Notes
• The 60-Day Price Guarantee applies only to qualifying standard online pricing changes.
• It does not apply to in-person market pricing or event-specific promotions.
• Claims must be made within a reasonable timeframe and may require proof of purchase.
• Store credit will be issued once eligibility has been confirmed.
• Store credit is non-transferable and cannot be redeemed for cash.
• Nelson Plant Guy reserves the right to amend or withdraw this guarantee for future purchases at any time.

13. Redeeming Points
Current standard redemption values include:
• 250 points = $5 off

Selected products may also be available exclusively through points-based rewards.
14. Referral Program
Under our standard referral programme:
• You may receive 10% off when an eligible referral spends $100 or more.
• The referred customer may receive 25 bonus points.
• Referral rewards are limited to a maximum of 10 qualifying referrals per week.
Referral offers may be changed, paused, or replaced from time to time.
15. Rewards, Vouchers & Fair Use
To keep our rewards programme fair:
• Points and vouchers are intended for genuine customer purchases.
• Unless otherwise stated, only one voucher or discount may be used per order.
• We may merge, adjust, or decline multiple small orders placed primarily to redeem multiple vouchers or circumvent promotional conditions.
• Misuse of the rewards programme may result in order cancellation, adjustment of rewards, or removal of points.
• Points expire after 12 months unless otherwise stated.
• Rewards are not transferable and cannot be exchanged for cash.
• Refunds are based on the amount actually paid and do not include the cash value of redeemed points.
16. NPG FOMO PREPAY — Terms & Conditions
Overview
NPG FOMO PREPAY allows customers to add store credit to a unique code linked to their account.

Standard top-up options may include:

Custom top-ups may also be available.
Your balance accumulates against your unique FOMO PREPAY code.
Redemption
• Enter your unique code at checkout.
• Credit may be used across multiple eligible orders until the balance has been exhausted.

Rewards Integration
Where applicable:
• Eligible top-ups may earn loyalty points.

Expiry
FOMO PREPAY credit does not expire unless required otherwise by law or subsequently agreed with the customer.
Non-Transferable
FOMO PREPAY codes are linked to the customer and cannot be gifted, sold, or transferred to another person.
Refunds
• FOMO PREPAY top-ups are generally non-refundable once purchased.
• Where an eligible order paid using FOMO PREPAY is refunded, the applicable amount may be returned to the customer's FOMO PREPAY balance.
Restrictions
FOMO PREPAY credit:
• Cannot be used to purchase gift cards.
• Cannot be used to top up another FOMO PREPAY balance.
• May not be combined with certain discounts or promotions.
• May not be valid on subscription products where applicable.
17. Privacy
Nelson Plant Guy complies with the New Zealand Privacy Act 2020.
Personal information collected through orders, customer accounts, subscriptions, enquiries, or other interactions will be handled in accordance with applicable privacy requirements.
We do not sell customer personal information.
18. Limitation of Liability
To the maximum extent permitted by New Zealand law, Nelson Plant Guy will not be responsible for indirect or consequential losses arising from an order, courier disruption, delay, or circumstances outside our reasonable control.
Nothing in these terms is intended to exclude, restrict, or modify any rights or remedies that cannot lawfully be excluded under New Zealand law.
19. Intellectual Property
Original photographs, written content, graphics, branding, logos, website material, and other content created by Nelson Plant Guy remain the property of Nelson Plant Guy and must not be reproduced, copied, or used for commercial purposes without permission.
Some product listings may also contain photographs supplied by breeders, laboratories, growers, suppliers, distributors, or other authorised sources, as well as publicly available reference images used to illustrate mature specimens.
Ownership of third-party photographs and other third-party material remains with the respective copyright owner. Their inclusion on a Nelson Plant Guy listing does not represent a claim by Nelson Plant Guy to ownership of that material.
Trade names, cultivar names, trademarks, breeder names, and other intellectual property appearing on our website may belong to their respective breeders, owners, laboratories, companies, or rights holders.
20. Special Offers & Discounts
All promotions, discount codes, early-access offers, subscriber offers, bundles, giveaways, and special pricing are subject to availability.
Additional conditions may apply to individual promotions.
Unless specifically stated otherwise, promotional offers cannot be combined.
21. Proprietary Cultivars, Tissue Culture & Commercial Propagation
Certain plant varieties supplied by Nelson Plant Guy are proprietary cultivars sourced through authorised breeders, laboratories, growers, rights holders, agents, or other authorised commercial channels.
This includes, but is not limited to, Monstera deliciosa ‘HUTAMT41’, commercially known as Vietciosa and Vietciosa Premium.
These conditions apply to proprietary cultivars supplied by Nelson Plant Guy in any form or stage of growth, including:
• Established plants.
• Acclimatised tissue-culture plants.
• Unacclimatised tissue-culture plantlets.
• Plants supplied in tissue-culture bags, vessels, flasks, or other in-vitro containers.
• Nodes, cuttings, meristematic material, callus, explants, or other propagating material.
Where a plant or tissue-culture line is identified by Nelson Plant Guy as a proprietary cultivar, purchase is subject to the commercial propagation conditions set out in this section.
Purchase transfers ownership of the physical plant, plantlet, tissue-culture material, or other stock supplied. It does not, by itself, grant the purchaser any licence, permission, authority, or commercial propagation rights relating to the cultivar, its genetics, or any intellectual property associated with it.
As a condition of sale, the purchaser agrees not to use proprietary plant or tissue-culture material supplied by Nelson Plant Guy as source material for commercial multiplication, laboratory propagation, or mass production unless prior written authorisation has been obtained through Nelson Plant Guy, where we act as the New Zealand agent, or directly from the relevant breeder, cultivar owner, trademark holder, or other applicable rights holder.
Without prior written authorisation, the purchaser must not:
• Supply a plant, tissue-culture plantlet, flask, bag, vessel, cutting, node, meristem, callus, explant, or other propagating material to a tissue-culture laboratory or propagation facility for commercial multiplication.
• Remove plant material from tissue-culture stock purchased from Nelson Plant Guy for the purpose of establishing, initiating, or expanding another tissue-culture line for commercial production.
• Use tissue-culture plantlets purchased from Nelson Plant Guy as explant, initiation, mother, donor, or source material for another laboratory culture.
• Commission, undertake, or arrange tissue culture, micropropagation, cloning, or other forms of commercial mass propagation.
• Use plants or tissue-culture material supplied by Nelson Plant Guy as mother stock or production stock for commercial mass propagation.
• Transfer tissue-culture material or propagating material to another nursery, laboratory, grower, business, or individual for the purpose of commercial multiplication.
• Reproduce or commission reproduction of the cultivar for wholesale, resale, commercial distribution, or commercial tissue-culture supply.
• Produce tissue-culture bags, flasks, vessels, plantlets, or other laboratory-propagated stock from material purchased from Nelson Plant Guy for subsequent commercial sale or distribution.
• Authorise, facilitate, arrange, or commission a third party to commercially reproduce or laboratory-multiply the cultivar on their behalf.
The purchase of tissue-culture material from Nelson Plant Guy is a purchase of the individual plant material supplied and does not constitute permission to establish a new tissue-culture production line from that material.
Likewise, the purchase of an established or acclimatised plant does not constitute permission to place that plant, or material taken from it, into tissue culture for commercial multiplication.
These restrictions do not prevent a purchaser from growing, maintaining, acclimatising, or displaying the individual plants purchased from Nelson Plant Guy, or from reselling the original plants or tissue-culture units purchased from Nelson Plant Guy, subject to any separate intellectual-property, licensing, trademark, cultivar, or other rights that may apply.
Where commercial propagation, tissue-culture multiplication, laboratory production, sublicensing, or other commercial reproduction is contemplated, enquiries should be directed through Nelson Plant Guy.
Where Nelson Plant Guy acts as the New Zealand agent for the relevant supplier, breeder, laboratory, or rights holder, we may liaise directly with them to confirm or obtain any required authorisation.
Certain cultivars may be subject to Plant Variety Rights, Plant Breeder’s Rights, plant patents, trademarks, contractual licensing arrangements, breeder agreements, laboratory agreements, or other intellectual-property protections in New Zealand or internationally.
The inclusion of a cultivar in this section does not represent that the cultivar necessarily holds a New Zealand Plant Variety Right. The nature, scope, and jurisdiction of intellectual-property protection vary between cultivars and countries.
Nelson Plant Guy reserves the right to identify additional proprietary cultivars or tissue-culture lines as they are introduced to our range and to specify additional cultivar-specific conditions where required by the relevant breeder, supplier, laboratory, or rights holder.
22. Force Majeure
We are not liable for delays or failures caused by events outside our reasonable control, including:
• Natural disasters.
• Severe weather.
• Courier or freight disruptions.
• Pandemics.
• Government restrictions.
• Biosecurity interventions or clearance delays.
• Border or customs delays.
• Transport interruptions.
• Other events outside our reasonable control.
23. Governing Law & Disputes
These Terms & Conditions are governed by New Zealand law.
Any dispute arising from an order, transaction, or these Terms & Conditions will be dealt with in accordance with applicable New Zealand law and through the New Zealand legal system where required.
